Department of Public Safety Notice of Public Hearing to Adopt and Amend Rules public hearing will be held in the Conference Room on the 2nd floor of the Sutherland Building, 118 West Capitol Ave Pierre, South Dakota, on July 19, 2018, at 1:00 p.m., to consider the adoption and amendment of the following administrative rules: ARSD 61:31:01:20, 61:31:01:21, 61:32:01:01, 6:32:01:02, 61:18:02:10, 61:18:08:02, 61:23:01:03, and 61:23:01:04 The effect of the rules will be to adopt the 2018 edition of the Commercial Vehicle Safety Alliance handbook, to establish requirements for certified nonprofit bus inspectors, revise the harvesting season and radius for hours of service exemption, establish driver license suspension periods for points accumulation, to revise the documents required to obtain a driver's license, update references to federal adoptions, and to create a declaratory petition process The reason for adopting and revising the proposed rules is to utilize the most current version of the Commercial Vehicle Safety Alliance, to establish rules for certified nonprofit bus inspectors, increase the harvesting season and increase the radius from source of commodity, provide driver's license suspension periods for points accumulation, align state driver licensing requirements with federal rule, and create a process for the Department to receive and respond to declaratory petition Persons interested in presenting data, opinions, andarguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Department of Public Safety, Sutherland Building, 118 West Capitol Ave, Pierre, South Dakota 57501.
